Arundale, Ann 1804

This is the last will and testament of me Ann Arundale of Healaugh in the Parish of Grinton in the County of York spinster made this twelfth day of August in the year of our Lord one thousand seven hundred and ninety seven in manner following, that is to say, whereas my father in and by his last will and testament gave and devised to me my heirs and assigns for ever all his freehold messuages lands tenements and hereditaments situate in the Parish of Grinton aforesaid subject to the payment thereout of the several sums hereinafter mentioned that is to say, the sum of twenty pounds to my brother William Arundale his executors administrators and assigns . The sum of fifteen punds to my sister Catherine for her executors administrators and assigns and the sum of fifteen pounds to my sister Alice Clarkson her executors administrators and assigns and thereby directed that the same should be paid within twelve months after the death of my mother Now I do hereby give and devise not only the same estate but also all other my freehold and leasehold messuages land tenements and hereditaments situate at Healaugh or elsewhere in the County of York unto my brother John Arundale his heirs executors administrators and assigns upon the trusts fillowing that is to say, upon trust to permit and suffer my mother and her assigns to receive the annual rents and profits thereof during the term of her natural life And from and after her decease upon trust either by mortgage or sale thereof to pay by and out of the money arising therefrom the several legacies chargeable by the will of my said father And after their discharge to pay thereout to my brother and sisters the following legacies that is to say; The sum of ten pounds to my brother William Arundale his executors administrators and assigns the sum of twenty pounds to my sister Alice the wife of James Clarkson her executors adminstrators and assigns which said several legacies so given by the will of my said father as also by this my will I do hereby order and direct my said brother John Arundale his heirs executors administrators and assigns to pay the same respectively within twelve months after the death of my said mother and after payment thereof I give and bequeath the residue of the money and such part of the premises as shall remain undisposed of for the purpose aforesaid unto my nephew James the son of my said brother John Arundale his heirs executors administrators and assigns provided that in case the money to arise by such sale should be deficient (after discharging the legacies left my said brother and sisters by the will of my said father) then with respect to the additional legacies made chargeable upon the premises by virtue of this my will I do hereby order and direct and my will and mind is that they my said brother William Arundale and sisters shall allow proportionably and rateably according to the amount of the legacies left by this my will I do hereby give and bequeath all my reay money securities for money and the money due thereon as also all my household goods and furniture plate linen and wearing apparel and other my personal estate not hereinbefore disposed of unto my said sister Catherine Foy her executors administrators and assigns (except one feather bed and all my wearing apparel which I do hereby give and bequeath to my said sister Alice Clarkson her executors administrators and assigns) she out of the residue thereof paying all my just debts and funeral expences, I appoint my said sister Catherine Foy sole executrix of this my last will and testament In witness whereof I have hereto set my hand and seal this day and year first within written
